The Africa Disability Protocol (ADP)

An African Law for African Realities.

Ratified by Kenya, this is the first human rights law tailored specifically to our continent. It tackles the unique cultural challenges we face—like stigma, superstition, and the need for community support.

1. Ending "Harmful Practices" (Article 11)

(The most critical section for safety) Unlike other international laws, the ADP specifically names and bans harmful cultural beliefs.

  • Witchcraft & Rituals: It is a crime to harm a person with a disability due to beliefs in witchcraft, magic, or “curses”.

  • Concealment: It is illegal to hide family members with disabilities from the public (locking them indoors) due to shame or fear.

  • Derogatory Language: The law prohibits the use of abusive or demeaning words to refer to persons with disabilities.

(Focus: You are not alone) Western laws often focus only on the “individual.” The ADP recognizes that in Africa, the family and community are the support unit.

  • Caregiver Support: The Protocol acknowledges that disability affects the whole family. It mandates the State to provide support services specifically for families and caregivers, not just the person with the disability.

  • Community Living: It promotes living within the community where neighbors and extended family play a role, rather than isolation in institutions.

  • The ADP is one of the first treaties to explicitly protect persons with albinism.

  • It strictly bans ritual killings and trafficking of body parts, recognizing the unique threats faced by this community in the region.
